The Condominium Act caps foreign freehold ownership at 49% of a building’s sellable area — counted by floor space, not by unit count. While quota remains open, the developer registers a unit directly to a foreign buyer, with no Thai company and no long-term lease involved. The remaining quota in a specific building isn’t a brochure figure: the developer is required to disclose it on request, and we confirm it separately before a deposit goes down.
Registering freehold for a foreigner requires the full purchase amount to arrive in Thailand from abroad, in foreign currency — only then does the bank issue an FET certificate (Foreign Exchange Transaction, formerly Tor Tor 3), without which the Land Department won’t register title. A transfer already in Thai baht, or split across partial payments through a Thai account, doesn’t satisfy this — the exact working route depends on the banks on both ends and changes over time, so it’s worth confirming for your specific deal before a deposit.
Once 49% of a building is held by foreign owners, the same unit sells as leasehold instead — usually a 30-year term with two renewal options (30+30+30). Most projects in this collection write a conversion right into the leasehold contract: if quota frees up later, because a foreign owner sells to a Thai buyer or a new phase adds space, the unit can convert to freehold. It’s an option, not a guarantee — worth confirming in the contract before signing.

Yes: a foreign heir can inherit a freehold unit, though under certain conditions — for example, if the inheritance would push the building over its foreign quota — a sale within a set period may be required.
